Befory Terms of Service

§ 1 Provider and scope

  1. The services offered under the name Befory at befory.eu are provided by ZahaRich UG (haftungsbeschränkt), Badstraße 26a, 79410 Badenweiler, Germany; Local Court (Amtsgericht) Freiburg, HRB 722412; Managing Director: Sergey Zakharov; VAT ID: DE450225864; phone: +49 171 1691182; email: info@befory.eu ("Befory", "we", "us").
  2. These Terms apply to all orders for the free preliminary report and the paid full report. Any conflicting terms of the customer do not apply.
  3. A customer is a consumer if they place an order for purposes that are predominantly outside their trade, business or profession.

§ 2 Services

  1. Befory prepares reports for buyers of property in Spain before they sign a contract (for example, an arras agreement). We currently cover properties in the provinces of Alicante and Valencia.
  2. The preliminary report is free of charge. It is based on the listing, publicly available cadastral data and the information you provide. It highlights discrepancies and open questions and lists the documents worth requesting. Up to three free preliminary reports are available per email address; a new set of three becomes available once a full report has been paid for. We aim to deliver the preliminary report within 3 business hours; this is not a binding deadline.
  3. The full report costs €99 and includes: ordering the nota simple from the Registro de la Propiedad at our expense; analysis of the nota simple and of the documents you provide; cross-checking them against the listing and the cadastre; an assessment of the risks found; and a list of questions and next steps.
  4. You choose the report language from: English, Spanish, German, Russian, Dutch, French, Italian, Polish, Swedish, Norwegian, Danish, Ukrainian.
  5. Reports are prepared with AI assistance: AI reads the listing, the cadastral data and the documents and cross-checks them; a person reviews the findings before the report is sent. AI can make mistakes.
  6. The report is delivered by email as a PDF (and, where appropriate, also as a DOCX file).

§ 3 Limits of the service

  1. Befory provides an information analysis. A report is not legal, tax, technical or financial advice and does not replace a review of the property by a lawyer (abogado), notary, architect or other professional.
  2. Befory does not act as a real estate agent, broker or representative of any party to the transaction and receives no commission from sellers or agents.
  3. The analysis is limited to the information and documents available when the report is prepared. A missing document is an open question, not proof that there is no risk. We do not guarantee that public registers or third-party information are complete or up to date.
  4. The decision to buy remains yours.
  5. Befory does not give legal qualifications, does not guarantee that there are no risks, does not carry out a technical survey and does not assess the market value of the property or whether its price is reasonable.

§ 4 Ordering and conclusion of the contract

  1. You request the free preliminary report via the form on our website. The contract is concluded when we confirm your request by email.
  2. You order the full report via a payment link on our website or in the email with your preliminary report. On the payment page you enter your details (and, where requested, details of the property), choose a payment method, accept these Terms and place a binding order by clicking "Pay". You can check and correct your entries before clicking. The contract is concluded when the payment has been completed successfully; you receive a confirmation by email.
  3. The contract consists of these Terms and the payment confirmation. These Terms are available at befory.eu/terms.html; we send the payment confirmation by email. There is no customer account in which the contract text is stored.
  4. The contract can be concluded in English, German, Russian or Spanish.

§ 5 Price and payment

  1. The full report costs €99 including VAT. There are no further charges; the cost of the nota simple is included.
  2. Payments are processed by Stripe (Stripe Payments Europe, Ltd.) using the payment methods shown on the payment page. Befory does not receive or store card details.

§ 6 Timelines

  1. Business hours are Monday to Friday, 9:00 to 18:00 Central European Time, excluding nationwide public holidays in Germany.
  2. Within one business day after payment, we confirm your order, request the nota simple and tell you which additional documents you should send.
  3. The full report is sent within 24 business hours after we have received the nota simple and the documents required for the analysis. The time the Registro de la Propiedad takes to issue the nota simple is outside our control; we will inform you of any delay.

§ 7 Customer obligations

  1. You provide accurate information about yourself and the property — the listing link and the address or the referencia catastral — and a valid email address.
  2. By sending us documents, you confirm that you are entitled to share them with us for analysis, including where they contain personal data of third parties.
  3. The report is for your personal use. You may share it with your advisors, your bank, the agent and other parties to the transaction. You may not publish it or pass it on for commercial use without our consent.

§ 8 Refund if the report cannot be prepared

  1. We refund the full amount using the original payment method in each of the following cases:
    1. the property is outside the provinces of Alicante and Valencia;
    2. the property cannot be identified after we have requested clarification — no valid address or referencia catastral is provided, or the listing is no longer available — and identification remains impossible 14 days after payment;
    3. the available information and documents are not sufficient to prepare the report and cannot be obtained.
  2. We inform you by email and refund within 14 days.

§ 9 Right of withdrawal for consumers

Consumers have a right of withdrawal as follows.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise the right of withdrawal, you must inform us (ZahaRich UG (haftungsbeschränkt), Badstraße 26a, 79410 Badenweiler, Germany, email: info@befory.eu) of your decision to withdraw from this contract by a clear statement (for example, a letter sent by post or an email). You may use the model withdrawal form below, but this is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your notice before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you without undue delay and in any event no later than fourteen days from the day on which we receive your notice of withdrawal. We will make the reimbursement using the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in any event, you will not incur any fees as a result of the reimbursement.

If you requested that the services begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services provided until you informed us of your withdrawal, compared with the full scope of the services under the contract.

Early expiry of the right of withdrawal

The right of withdrawal expires when the service has been fully performed, that is, when the report has been delivered, provided that before we started you expressly agreed that we begin before the end of the withdrawal period and confirmed that you know you lose your right of withdrawal once the contract has been fully performed. You give this consent by ticking the box on the payment page.

§ 10 Liability

  1. We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under mandatory statutory provisions such as product liability law.
  2. In cases of slight negligence, we are liable only for breaches of essential contractual obligations, meaning obligations whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment the customer regularly relies. In that case, our liability is limited to the foreseeable damage typical for this type of contract.
  3. Otherwise, liability for slight negligence is excluded.

§ 11 Data protection

We process personal data in accordance with our Privacy Policy: befory.eu/privacy.html.

§ 12 Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 13 Final provisions

  1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you have your habitual residence.
  2. These Terms are published in English, German, Russian and Spanish. In the event of discrepancies, the German version prevails.
  3. If any provision of these Terms is invalid, the remaining provisions remain effective.
